This is a regulatory loss, not a rate hike announcement
Canadian Utilities Limited (TSX: CU) said September 4 the Alberta Court of Appeal dismissed the appeal of its Alberta-based utilities on prior Alberta Utilities Commission decisions related to the Performance-Based Regulation 2 Reopener. The company is reviewing the decision and considering next steps.
CU framed PBR as a framework that rewards cost reduction while keeping service safe and reliable, with savings shared back to customers. It argued a predictable regulatory regime is needed for utilities to invest and innovate. CU also said its Alberta utilities are the only ones in the province to cut distribution costs by 8 percent, or about half a billion dollars, over the current PBR3 period.
This release does not change customer bills today. It is about whether prior AUC rulings on the PBR 2 Reopener stand after court review.
Neutral read
CU is on the listed utilities list. Banks were skipped. A dismissed appeal and a review period are the facts. Write this as regulatory process, not as a dividend or capex story. Watch whether CU files a further appeal, how the AUC applies PBR3 incentives, and whether Alberta's broader rate-design debate moves before winter.
